Divorce Petition

If you have decided that you wish to terminate your marriage you will be required to fill in a divorce petition, called Form D8, which must be filed at a local divorce court. You will be required to fill in three copies of this Form D8 (divorce petition). One copy is for you, one for your husband/wife and another for the court.

If adultery is the ground for divorce you need not name the person with whom your husband/wife has had an affair (identified as the co-respondent), however if you do wish to name the co-respondent you must fill in another copy of the divorce petition Form D8 for them.

If there are children involved you will be required to fill in three copies of Form D8A, which is a statement of arrangement for the children.

On the petition you will be required to write the date when you were legally married, when you last lived together as husband and wife and if you have any children. You will need to name any children under the age of 16, or in full time education or taking part in a vocational course when under 18.

Irretrievable breakdown of marriage must be proved, to the court, by using one of the following grounds for divorce: - adultery, unreasonable behaviour, desertion, or separation.

There is a part of the form, named the Particulars section, where you can state your allegations that you wish to use to prove grounds for divorce.

What happens after I have filed the divorce petition D8 (D8A)

After you have sent the court your copies of Form D8 (D8A) you will receive a Form D9H (notice of issue of petition). This tells you when the petition was sent to the respondent (your husband or wife) and this form also gives you your divorce case number. The form also says what you need to do if the respondent (or co-respondent) does not reply. A copy of your petition with the form D10 (acknowledgement of service) will be sent to the respondent and any named co-respondent. After the respondent (and any co-respondent) receives the form a period of 8 days is given for the return of the acknowledgement of service.

When the court receives the Form D10 from the respondent (and any co-respondent) hey will send a copy to you. On the returned Form D10 it will state whether the parties wish to contest your petition/ or the court’s announcement or whether they agree with the petition.
